MACUNGIE INSTITUTE

TERMS AND CONDITIONS FOR USE OF FACILITY

1. GENERAL ELIGIBILITY FOR USE
  The Borough of Macungie is pleased to offer meeting facilities to interested groups.  The Macungie Institute is intended for use by the Users who have cultural, educational, business-related or community spirited purposes.  Special consideration will be given to citizens, non-profit organizations or groups residing in the Borough of Macungie.

The Trustees and Building Coordinator of the Macungie Institute reserve the right to limit or reject any Users, which, in their sole discretion do not meet appropriate safety requirements or do not promote the objectives of the Macungie Institute.

   
2. FEES  (Effective January 1, 2011)
  The Macungie Institute reserves the right to charge user fees and/or security deposits when appropriate, in the sole judgment of the Trustees or Macungie Institute Building Coordinator.  Fees are to be paid at least one week prior to usage date.

The building is usually available for rental anytime, seven days a week, subject to availability.

All rentals are handled by the Building Coordinator who may be contacted at (610) 966-7830.

   
3. PROHIBITED ACTIVITIES
  The Borough of Macungie is pleased to offer meeting room facilities which are:

Alcohol - free
bullet 
Pet - free
bullet 
and without unruly or loud behavior
   
  All Building Users are expected to conduct themselves in an appropriate manner.  Users who are unable to abide by these rules will be denied permission for future use of facilities within the building.
   
4. HOUSEKEEPING REQUIREMENTS
   
  In general, Users shall leave the Macungie Institute in the same or better condition than in which it was found.  Trash should be placed in designated trash containers and full bags should be placed outside the Kitchen door for pick up by the Borough Crew.
   
5. INSURANCE REQUIREMENTS
  Depending on User proposed activity(ies), the Trustees or Macungie Institute Building Coordinator may require proof of appropriate insurance coverage in the form of insurance certificates.  Should an insurance certificate be required, the certificate must name the Macungie Institute as a certificate holder and an additional insured.  Satisfactory evidence shall be provided by the User which indicates that insurance has been obtained and that such policies will be maintained in force throughout the period in which the use of the Macungie Institute is offered to User.
   
6. INDEMNIFICATION
  USER AGREES TO INDEMNIFY AND HOLD HARMLESS THE BOROUGH OF MACUNGIE AND THE TRUSTEES, ADMINISTRATORS, OFFICERS, EMPLOYEES AND AGENTS FROM AND AGAINST ALL LIABILITY, CLAIMS, SUITS, LOSSES, DAMAGES, COSTS AND DEMANDS, INCLUDING REASONABLE LEGAL EXPENSES AND ATTORNEY'S FEES CONNECTED THEREWITH, ON ACCOUNT OF PERSONAL INJURY, INCLUDING DEATH OR PROPERTY DAMAGE SUSTAINED BY ANY PERSON OR ENTITY ARISING OUT OF OR CONNECTED WITH ANY EVENT(S) OR ACTIVITY(IES) CONDUCTED BY USER(S) AT THE MACUNGIE INSTITUTE.
